1. Acceptance of Terms

By downloading, accessing, or using the BirdSong application ("the App"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the App.

2. Intellectual Property Rights

The App and its original content, features, and functionality (including but not limited to all sounds, wallpapers, and design) are owned by BirdSong and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to download and use the App for your personal, non-commercial purposes. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

3. Subscriptions (BirdSong Pro)

Some parts of the App are billed on a subscription basis ("Pro"). You will be billed in advance on a recurring and periodic basis (such as yearly). At the end of each period, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.

You may cancel your Subscription renewal either through your online account management page (Google Play Store or Apple App Store).

4. Prohibited Uses

You agree not to use the App:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
• To attempt to extract the audio or image files from the App for distribution outside of the App's intended sharing mechanisms.

5. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein.

6. Limitation of Liability

In no event shall BirdSong, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
